General Terms and Conditions of Use of the anjou-tourisme.com booking platform
Anjou tourisme publishes on its Website a Platform enabling Professionals in the tourism sector, members of the regional marketplace eRESA, to publish Offers and Users to book these Offers directly on the Platform.
Definitions
. General Terms and Conditions of Use (GTCU), refers to the present general terms and conditions of use of the booking Platform.
. Offer, refers to the Professional's tourist service visible on the Platform and bookable by the User.
. Platform or Destination Platform, refers to the area of the Anjou tourisme Website used to book Offers.
. Professional, refers to the member of the eRESA regional marketplace, a tourism services professional, proposing Offers accessible and bookable on the Platform.
. Third Party, refers to any individual or legal entity outside the GCU.
. User, refers to the person booking an Offer from a Professional via the Platform.
Purpose
The purpose of these GCU is to define the terms and conditions under which Anjou tourisme allows a User to consult and reserve an Offer from a Professional via the Platform.
These GCU apply without restriction or reservation to any use of the Platform.
The User acknowledges having read and accepted without reservation the present GTU which prevail over any other document.
Anjou tourisme reserves the right to modify, at any time and without prior notice, these GTU in order to adapt them to changes in the Platform and/or its operation. The modifications of the GTU are opposable to the Users from the moment they are put online.
Access and availability of the platform
Access to the Platform
Any User may use the Platform for personal, non-commercial use.
The User declares :
- He/she is at least eighteen (18) years old,
- Be legally capable of creating binding legal obligations,
- That all the information he/she is required to provide in order to book an Offer is true, accurate, up-to-date and complete.
Access to the Platform to consult the Offers does not require prior registration. The process of reserving an Offer may require the communication of personal data necessary for the execution of the reservation.
Availability of the Platform
The Platform is accessible 24 hours a day, 7 days a week.
However, the availability of Third Party systems and in particular the Internet is limited by technological and environmental factors likely to impact data transmission. The Platform may therefore be limited or temporarily unavailable, without prior notice. Anjou tourisme cannot be held responsible for malfunctions and interruptions linked to these third-party services.
Furthermore, Anjou tourisme reserves the right to punctually interrupt access to the Platform in order to ensure the security and maintenance of its IT infrastructures.
Consulting offers
The User may freely consult the Offers present on the Platform.
As a distributor, Anjou tourisme does not sell Offers and only offers the consultation and reservation of Offers previously placed on the Platform by a Professional.
Anjou tourisme hosts the content, including prices, availability, images and other information made available or obtained from the Professional. Anjou tourisme cannot be held responsible for the accuracy, quality, completeness, reliability, Anjou tourisme having no influence on it.
Booking an Offer
The User can book the selected Offer directly on the Platform.
The User is informed that the Professional's general terms and conditions of sale will apply to the booking. Thus, modifications, cancellations and refunds concerning the reservation of an Offer must be made directly with the Professional.
Anjou tourisme in no way guarantees the compliance of the Professional's general terms and conditions of sale, as well as the services they offer and the conditions under which these services are carried out, with the applicable legal and regulatory provisions, particularly in terms of consumer law, and it may not be held liable in this respect.
By reserving an Offer on the Platform, the User acknowledges that Anjou tourisme is only an intermediary and does not enter into the contractual relationship between the User and the Professional. Anjou tourisme is therefore considered as a Third Party to the transaction between the Professional and the User.
Reservations made by the User may be of two types depending on whether :
- the Professional offers an online payment method: in this case, the User must pay the price of the holiday online and his/her holiday will be confirmed.
As soon as confirmation of the booking is received, a legally binding agreement is established between the User and the Professional, - the Professional does not offer an online payment method: in this case, the User may only make a reservation request which must be confirmed by the Professional, who may refuse it, in particular for reasons of availability of the accommodation. In the event of such a refusal, Anjou tourisme may not be held liable.
In case of acceptance of the reservation request by the Professional, a legally binding agreement is established between the User and the Professional.
Anjou tourisme is in no case responsible for a failure, a modification or any other problem encountered by the User during the reservation of the Offer.
Anjou tourisme is not responsible for the proper execution of the contract between the Professional and the User.
